There is an immense amount of power in the hands of criminal prosecutors today.  You may ask how that impacts you.

We think we understand the law and most of us can rattle off the names of crimes without having to think about it:  murder, theft, battery, and rape, etc.

But what most people don’t understand is that laws that were regulatory have expanded.  Now people are very likely to break the law without knowing it!

Over the centuries, there has been an increasing scope of people who can be victims of crimes.  Way back during the Roman Empire, a Roman man, head of the household, would not be prosecuted if he were to beat his slaves, his children or his wife to death!

Property crimes were considered as bad or worse than crimes against people, i.e., horse thievery. This was because the laws were made to protect wealthy people.

As we have become more democratic, crimes against property became less serious than crimes against people.  Even then, old ways hung on: The concept of raping a spouse only became criminal in 1920!   

Furthermore, we have the legislature always working and making new laws.  As more people are charged and convicted with crimes, and as incarceration increases, legitimate options for convicted people have gotten smaller.  As jail sentences have gotten longer and judges are encouraged to give the harshest sentences, people are branded as ex-cons forever.  They have limited access to societal help.  The result is that we are creating more people who are incapable of reintegrating into society.

What are the consequences to you?

  • More people have to live outside the general society.  They have to engage in criminal activity because of lack of options.
  • Laws that used to be regulatory now can be a federal offense and this includes the act of filling out federal forms incorrectly!

Matt urges DACA recipients to renew their applications before October 7th!  They will be guaranteed up to 2 more years in the US.

800,000 people are protected under DACA and need to move from where they are to something that will allow them to continue their lives in the United States.

Two and a half million children came into the country in recent years and have been here 5 to 20 years!

  • Someone who is a brother, sister, child or other relative of someone who is here legally.
  • Someone whose continued survival is at stake if they are not allowed into the U.S.A., i.e. Syrian and Venezuelan refugees.

There are millions of people who want to come to the United States but only a few hundred thousand legal entries are allowed each year.

Matt warns DACA recipients that prosecutorial focus has been on criminal aliens and it is important that DACA recipients do not contemplate breaking the law in any way.  If you are charged with a crime, you will not get the benefit of the doubt no matter how long you have been in the U.S.A.

Matt Bromund – Fighting For Your Future: What You Must Know About Criminal Intent – A Survival Guide!

This Week, Matt Bromund, Principal Attorney of The Bromund Law Group, analyzes mens rea – criminal intent, and helps us understand this complicated and important subject.

Criminal Intent is much more the subject of controversy than the criminal act (actus reus) that Matt analyzed last week.

The law has a difficult time figuring out which intentions should be criminal and the Courts have a very difficult time figuring out how to know what a person intended when they committed an act.

There are three standards of criminal intent that are prohibited:

  1.  Malice
  2.  Specific Intent
  3. General Intent

Malice only exists for two categories of crime:  Murder and Arson.  This has to have a very high standard of criminal intent because the act can be motivated by a wide array of intentions.

Murder has been prohibited by society.  Homicide, on the other hand, can be justified in a number of situations.  The first situation that comes to mind is one of self-defense.  Other examples can be in the case of a soldier killing in war, and/or consensual sporting encounters.

Malice requires having an evil intent.  This standard recognizes that there can be evil intent.  The person’s intent anticipates some sort of pleasure in the resulting death.

A few great take-aways from the show – Rules of Successful Criminal Defense:

  1.  Don’t put yourself in a position where violating the criminal law seems like the reasonable thing to do.
  2. If you find yourself in a situation where violating a law might be a possibility, make sure you make your intent clear to family, neighbors, friends.
  3. If you are being questioned by the police, accept that you are in a situation where you will never convince them of your innocent intent.  DON’T SAY ANYTHING!

More and more our world is becoming one governed by law.  What is necessary for something to be criminal?  What does it mean to comply with the law and what is it to commit a crime?

Mens rea is the intention to do something not good for society.

Today Matt focuses on the 2nd component of criminal law:  Actus reus. “Action or conduct that is a constituent element of a crime.”

What sort of acts form the basis of a criminal violation?

  • A thing we do that just affects ourselves.
  • A thing we do that affects people close around us.
  • Acts that affect the broader town we work in:  When you steal something, or deface something  – that affects society. Graffiti is an example of this act.
  • Acts that harm greater society’s ability to relate to each other.  Examples: Spreading lies about someone else or destroying a bridge.
  • Acts that harm a structure or system that is harmful for society as a whole:  Examples: Treason, assassination, terrorism.

Each category has a different history determining how much one can do without it being criminal.

Matt Bromund – Fighting For Your Future: The Truth About Racial Identity And The Law.

In his timely show, Matt Bromund examines how the law relates to race and racial identification and how that affects us.

The truth about race is there is a singularly tiny amount of genetic contribution to racial identity.  Racial identity is actually based on how we look.

Race in America has to do with social identification placed on people by the society.  Racial identity is a social construct!

Matt relates how he, a Millennial,  has never lived in a time where race is discriminatory in the law. Though, of course, this social construct affects how the law sees people in practice.  In criminal law, the most likely person to be incarcerated is and African-American male and the person most likely to escape conviction is a white female.

Courts make assumptions – different races are perceived differently.  This includes  Criminal, Family and Immigration Courts of Law.

For example, let’s look at the recent incident in Charlottesville. Matt maintains that if the men carrying the torches had been Black men, the police would have been more aggressive because of their perception of men and particularly Black men.

Matt: “Race influences our expectations the most in our society.” 

Matt wants his listeners to examine their expectations.  Do you judge people on how they look?  How can you unpack these expectations and view your fellow humans with more clarity?

Today, Matt Bromund dissects the law for our benefit!  From the 10 commandments to the 21st Century!  How come  it is so easy for the everyday person to break the law nowadays?

The answer is easy:  There is so much more law.  Living as a law-abiding citizen is more complicated!

In ancient times, it was hard to chisel words on stone and this physically encouraged simplicity and brevity – “Thou shalt not kill.”   Today, billions of words are analyzed, honed to their exact meanings, and stored in huge data bases by legislative bodies.

Politics also comes into the equation, Matt says. Legislators write laws or eliminate laws to make a difference – to make the world a better place.  The law writers want to make sure that their individual ideas get stamped on the law.  Legislatures don’t think about how their proposals affect other laws that are in effect.

The result is that everybody has an incentive to make more law. And so the body of law grows.

Important Question:  Who is left out of the situation?  Answer: The ordinary person.  Now laws are supported by more laws, rules, and regulations. The result is that it is easy to break the law.  For instance, it is the law that you must have a front license plate on your car.  Specifically, in California, you can get a ticket for not having it affixed at a certain height and in a specific way.

Since the 1950s, “You have the right to remain silent” has a been a stock phrase.  It’s in books, TV shows and the movies.  We the people are very familiar with it – it means “You are under arrest.”

What most of us don’t know, Matt says, is that this right does not only come into play when people are under arrest.  It is ALWAYS important and comes into play when anyone is dealing with the government from a police officer to a dog catcher!

The Founding Fathers knew that the right to remain silent is critical to being a sovereign and free person.  This is because the government has a lot of power.  They can physically take you and hold you, take your land, your property and confiscate your things.  They can put you to work without pay if you are convicted of a crime.  They can even take your life.

We have been brought up to tell the truth and be honest; We find it difficult to NOT say anything.    This can work against us in dealing with the government.

From over a decade of experience, Matt says that, overwhelmingly, the greatest source of evidence used to convict people wrongly of a crime is their own statements!

Matt Bromund – Fighting For Your Future: Immigration History And DACA – One Solution?

In this timely new show, Matt Bromund, Principal Attorney of the Bromund Law Group, delves into the history of Immigration Law and how that relates to the Deferred Action for Childhood Arrivals Program (DACA).

The DACA program is for people who were brought to the U.S.A. as children.  It is an exemption from the harsh penalties in the law that have been in effect for the last 20 years.

Before the 1950’s: 

An Immigrant would be welcomed into America if he or she were willing to work.

They could stay if they resided here for a period of time, could operate well with the English Language, and were willing to swear an oath to the Constitution of the United States.

That began to change with the Social Security Act of 1935.  In the 1950’s, the country made a big shift in how people related to the government.   Problems arose when the government started giving benefits directly to people just for being in the country.  This created a problem because the government cannot be sure that the people receiving benefits are contributing enough to justify receiving benefits.

Thus came the Immigration and Naturalization Acts that moved the country further away from the idea of welcoming immigrants who are simply here to work to support themselves.  The USA kept cutting back.  The result – immigration became extremely restricted.

Fast forward to 2012 when President Obama signed the DACA executive order.

DACA Rules –  You may qualify for DACA…  

  • If you were under the age of 31 as of June 15, 2012.
  • If you came to the US before you reached your 16th birthday.
  • If you were here 2007 to today, 2017. (10 continuous years)
  • If you were physically here on June 15, 2012 without legal status.
  • If you have been in school or graduated from high school, or been in the military, or honorably discharged, and haven’t been convicted for a serious crime.

If you fit the above criteria, then you can get employment authorization!

Statistics show that immigrants are mostly employed compared to native-born Americans.  Less than 1/2 percent are unemployed.  It makes sense, Matt asserts, that since the USA spent money on the education of DACA hopefuls, that the country would also benefit from them being in the work force.

DACA is a critical step towards getting 4-5 million (yes that many!), people back into the system where they would be contributing and paying taxes to the society where they are receiving benefits.

Matt Bromund – Fighting For Your Future: DUI LAW – Common Sense Or Conundrum?

matt_7_15_17_border2In this week’s detailed and fascinating new show, Matt Bromund, Principal Attorney of the Bromund Law Group, dives into the common sense and conundrum of DUI law.

We have all been inundated with decades of advertising that point out the dangers of drinking and driving.

Common sense and experience tells us that focus, attention and skill are needed to drive a motor vehicle.

The problem comes when we take a common sense proposition and turn it into law.

Once the population got the idea that drinking and driving was dangerous and done all the time, the legislature:

  1. Lowered the blood alcohol levels allowed in the system
  2. Simplified the burden of proof needed for the government to prove you are under the influence
  3. Increased financial penalties and a benefits for the state.

Now a DUI can be a net gain of $10,000-$15,000 for the state of California.  The cost for the defendant can be $25,000-30,000.  Of course, one cannot put a price on someone’s life.  However are these people criminals in the true sense of the word?

Common sense and experience has shown that there are two kinds of people who drink and drive.

  1. Alcoholics – who are people who are struggling with the disease of alcoholism
  2. People who don’t think they are under the influence – people who perceive that they are okay after a drink or two.

Alcoholism:  There are some counties and judges that are trying to shift from a punitive to a more therapeutic approach but that is not all counties.  That effort is mainly piecemeal in California. When Matt recognizes that a client may be suffering from alcoholism, he works to aggressively get that person into support groups and therapy.
