Matt Bromund: Fighting For Your Future – Crafting Family-Friendly Child Custody Agreements!

Matt_6_24_17_borderIn the first show of the summer, Matt Bromund of the Bromund Law Group,  tackles the emotionally charged subject of child custody.

In present-day California, Matt says, the Courts start with the premise that both parents are perfectly capable of caring for their children.

However, historically, before the Victorian era, (1837 to 1901) the father was given custody because he would be the one most likely able to financially sustain the children.  The family business was most likely in and around the home, like the family farm, or a smithy business.

During the Victorian era, ideas shifted and the “tender years doctrine” came into being.  The idea was that a mother should devote herself to child rearing and home management and therefore should get custody of the children.

Matt calls that the beginning of the “June Cleaver era,” (named after Leave It To Beaver, a 50’s television show). This was when men were supposed to go out in the world to work.  When there was divorce, the man was to support the family with his superior wealth because mom was still at home with the children.

The Law caught up around the end of the June Cleaver era and no fault divorce came in with idea of equal time with the children for both parents.

2017 – Present-day:  Matt maintains that the best family decisions are made between family members outside the court.  He finds that the longer he works with a family on an agreement, the better the outcome is for everyone.  However, if there is a parent caught up in rage, jealousy, and/or addiction, then the judge’s input is necessary and important.

It is permissible to tailor an agreement that is unique to a family that may not look like equal time for both parents but works for the family as a whole.  For example, if Mom is in the military and Dad is a civilian, there might be an agreement where Dad has the children 100% of the time while Mom is in Iraq. When she gets home, Mom has the children 100% for a period of time.  Then the schedule will change again and is worked so the children get the benefit of being cared for by both parents for large chunks of time.

Matt Bromund: Fighting For Your Future – Juvenile Dependency or “Parents’ Court”

BromundHeadshot6In his important new show, Matt Bromund, of the Bromund Law Group talks about the Juvenile Justice System and the challenges faced by families in Juvenile Dependency Court.

“How a society treats its most vulnerable people is a clear test for the morality of a society.”  In Juvenile Dependency Court, both children and parents are vulnerable.

The Two Courts In the Juvenile Justice System:

Juvenile Delinquency Court –  where a minor commits a crime or some kind of misconduct.  Over the last ten years it has improved its ability to sanction minors that commit misconduct in a way that doesn’t set them on a life time of crime.

Juvenile Dependency Court  – This is essentially “Parents’ Court” where parents have allegedly engaged in some kind of abuse or misconduct.  They are in the system to determine whether their child needs to be taken from them for the protection of the child.

The legislature has responded to the general belief that children need to be protected… Juvenile Dependency Court is complex and challenging because is is about who decides what is necessary to protect the child.

That decision has been placed in the hands of social workers, Child Protective Services (CPS).  However CPS hasn’t a good way to determine the truth of a claim!

In Juvenile Dependency Court rules that have been developed in the Courts in evaluating in people’s credibility, i.e., a higher standard of proof, beyond a reasonable doubt, get tossed aside.  

In the criminal system, if you can’t prove it, it stays the same.  However in the Juvenile Dependency System, the standard is not the same.  It is up to the Judge – who may take the child away from parents or guardians with the idea of protecting the child  – even if there is no solid proof of abuse.

Matt cannot control what the Judge may do, but he can prepare the parents to understand what they are going into.

How does Matt work in a case in Juvenile Dependency Court?

  • He works hard to understand the facts.
  • As the attorney for the parent, he attempts to get an interview with the child, but that request is often denied by the judge.  There is no disputing that decision.
  • He determines what has happened with the child in the weeks before in order to get to the facts about possible abuse or other reasons for bruises or injuries.

Matt Bromund: Fighting For Your Future – The Value of Hindsight, Foresight, And Clear Observation

The “stuff” of law school is buying casebooks… the assumption after law school is that Matt was prepared to work in law.  However, as soon as he began practicing law, the books went on the shelf and were not opened again.  In practicing law, Matt says, the experience matters more.

Matt, 43, calls his generation, (Generation X)  the “cynical Gen X’s.” They have watched their “overwhelmingly optimistic” Baby Boom parents incur massive debt and exhibit the inability to speak about life challenges.

Matt Bromund: Fighting For Your Future – A Bridge Between Civil And Military Law

Matt_uniform_borderIn his illuminating new show, Matt bridges the two worlds of military and civilian law.  He tells us about the similarities.  For example, the hard facts:  Criminal acts are recognized everywhere – some are rape, battery, murder.

Yet, he says “There are big distinctions between the military and civilian world and they don’t understand much about each other.”

For instance – unauthorized absences:  In civilian law, if one doesn’t show up for work, he or she gets fired.  Conversely, when a soldier or sailor doesn’t show up for work, they may spend years in jail depending on circumstances.

The Uniform Code of Military Justice is the law that governs active duty soldiers and sailors and it is a different experience representing a person in the military… there are different demands on military families.  Matt understands this.  His father was in the Coast Guard for many years and retired at the time Matt became an attorney with the Jag Corp (Judge Advocate General’s Corps).  Essentially, Matt has had a lifetime in the military.

He also understands that civilians have little contact with the military in everyday life.  The overlap is often difficult and contentious and military personnel have to deal with a world that doesn’t understand them.

This life and job experience gives Matt a unique set of skills and an advantage over typical attorneys in helping people in Ventura, Santa Barbara and L.A.  Counties.  With his knowledge and experience, Matt can effectively be a bridge of communication between the two courts.  Bromund Law has that expertise to offer military families with someone in active duty.

In his illuminating new show, Matt cites the Lautenberg Amendment as a striking example of disconnect between the civilian and military worlds.  Written by Frank Lautenberg, the law makes it illegal for a person convicted of domestic violence to carry a firearm.  This works well in civilian law but creates big problems for military families.  If a soldier is not allowed to carry a firearm, he or she will eventually be processed out of the military!  This loss of work and income creates great hardship for the family and has led to a reluctance of military families to report domestic violence.  In an attempt to work around this amendment, the Marine Corps now defines their weapons as something other than firearms!

When Matt goes into a courtroom in Ventura, Santa Barbara, and Los Angeles, he knows more than the typical attorney and the courts know that!

He, like all lawyers, still was ethically required to see if there is reasonable doubt to a jury. However, his client had confessed and was caught.  There was no obvious victory to be gained.
